Attorney General Dan Rayfield alongside a coalition of 28 attorneys general filed an amicus brief in support of the Federal Communications Commission’s (FCC) One-to-One Consent Rule. The coalition argues the rule is an important step to stop the flood of robocalls that are bothering consumers.
“In Oregon, we have worked to crack down on these illegal calls. This rule is key to tackling the problem,” Rayfield said. “By making sure businesses have clear permission before reaching out, we’re helping protect consumers from unwanted calls and putting the power back in their hands to control their privacy. We urge the court to reinstate this protection.”
The One-to-One Consent Rule, adopted in late 2023, requires telemarketers and lead generators to obtain explicit consent from consumers before contacting them and selling their contact information. On January 24, 2025, the Eleventh Circuit Court of Appeals issued a decision vacating the rule, finding that the FCC exceeded its statutory authority under the Telephone Consumer Protection Act. This means that this extra protection for consumers is no longer in effect. The state’s amicus brief urges the full Eleventh Circuit to reconsider its ruling and uphold the rule.
According to the Federal Trade Commission (FTC), consumers reported losing more than $1.2 billion to scams because of robocalls and text messages in 2023. In their brief, the coalition argues that the One-to-One Consent Rule is a critical enforcement tool that complements state efforts to stop illegal robocalls.
Joining Attorney General Rayfield in filing this brief are the attorneys general of Arizona, California, Colorado, Connecticut, Delaware, the District of Columbia, Hawai’i, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New York, North Carolina, Ohio, Rhode Island, South Carolina, South Dakota, Utah, Vermont, Virginia, Washington, West Virginia, and Wisconsin.
